Types of NGO Registration Available in Assam
In Assam, NGOs are usually registered in one of three legal forms: Trust, Society, or Section 8 Company.
Trust Registration in Assam
A public charitable trust in Assam is created by a Trust Deed that clearly specifies the charitable objects and the property dedicated to public benefit.
Key trust deed requirements for an NGO in Assam:
- Name and registered office address of the trust.
- Names, addresses, PANs, Aadhaar numbers, and photographs of the settlor and trustees.
- Clear charitable objects (education, health, relief of people with low incomes, etc.).
- Rules on trustee powers, meetings, bank operation, and dissolution.
The deed is executed on appropriate stamp paper and then submitted to the local authority (charity/registration office) along with ID/address proofs to obtain registration.
Society Registration in Assam
Society registration in Assam is done under the Societies Registration Act, 1860, as adapted by the state.
Basic requirements for society registration in Assam:
- Minimum 7 persons associated for literary, scientific, or charitable purposes.
- Memorandum of Association (MOA) detailing name, objects, members, and registered office.
- Rules & Regulations of the society, duly signed by all founding members and witnessed.
- Registration fee (for example, the Government of Assam prescribes Rs. 50 as basic registration fee for societies under a specific head of account).
Societies in Assam can now also use online portals such as the state e‑governance/EODB systems to submit applications, making it easier to register from anywhere in the state.
Section 8 Company Registration in Assam
A Section 8 Company is a not‑for‑profit company formed under the Companies Act, 2013, for charitable objects such as education, environment, social welfare or art and culture.
Key features of the Section 8 company registration process in Assam:
- Minimum: 2 directors and members, with at least one resident director in India.
- Digital Signature Certificates (DSC) and Director Identification Numbers (DIN) for all directors.
- Name approval and incorporation through the SPICe+ (Part A and B) forms on the MCA portal.
- Filing MOA (INC‑13) and AOA in prescribed formats, plus AGILE‑PRO, INC‑9 and related forms.
Once these documents are approved, you receive a Certificate of Incorporation with a CIN, and the entity operates as a full‑fledged NGO company.
